These Terms of Use (“Terms”) govern your access to and use of the Mail Vidi Vici platform (“Mail Vidi Vici”, “we”, “our”, “us”). By accessing or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.

Key point: Lookup data may be inferred or probabilistic. You are solely responsible for your downstream use and legal compliance.

1. Eligibility & Business Use Only

  • You must be at least 18 years old.
  • You may use the Services only for lawful B2B purposes.
  • You represent that you have a legitimate business purpose for access and use.

2. Account Responsibility

  • You are responsible for all activity under your account.
  • You must maintain accurate account information.
  • You must safeguard your credentials.
  • We are not responsible for unauthorized access caused by your failure to secure your account.

We may suspend or terminate accounts at our sole discretion.

3. License & Restrictions

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services.

You may not:

  • Scrape, crawl, harvest, or extract data using automated means
  • Reverse engineer or attempt to derive source code
  • Resell, sublicense, redistribute, or mirror lookup data
  • Bypass usage limits, credits, or security controls
  • Use the Services for consumer marketing or personal purposes
  • Use data in violation of GDPR, KVKK, CCPA/CPRA, CAN-SPAM, PECR, or similar laws

4. Lookup Data & Inferred Information

  • We may provide inferred, generated, predicted, or validated professional contact data.
  • Data may be incomplete, inaccurate, outdated, or probabilistic.
  • No warranties regarding accuracy, completeness, or deliverability.

You acknowledge that:

  • Lookup data is provided “as is”.
  • You do not rely on Mail Vidi Vici to determine the legality of your communications.
  • You are solely responsible for downstream use of lookup data.

5. Compliance Obligations (User)

You are solely responsible for ensuring your use of the Services and lookup data complies with all applicable laws, including GDPR, KVKK, CCPA/CPRA, CAN-SPAM, ePrivacy/PECR, and any anti-spam or marketing rules in your jurisdiction. We do not provide legal advice and do not monitor your compliance.

6. Payments & Subscriptions

  • Payments are processed by Stripe.
  • We do not store payment card data.
  • Subscriptions may renew automatically unless cancelled.
  • Fees are non-refundable unless required by law.

Non-payment may result in suspension or termination.

7. Remove-Profile & Suppression

  • Lookup Subjects may request suppression or removal.
  • You may not attempt to circumvent suppression mechanisms.
  • Violation may result in immediate termination.

8. Intellectual Property

All intellectual property rights in the Services (including algorithms, inferred datasets, and software) belong to Mail Vidi Vici. You receive no ownership rights in any inferred or generated data.

9. Termination

We may suspend or terminate your account immediately for Terms violations, abuse/excessive usage, legal/regulatory risk, or non-payment. Upon termination, all licenses granted to you end.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Total liability will not exceed the amount paid by you in the preceding three (3) months.

12. Arbitration, No Class Action, Governing Law

  • All disputes shall be resolved by binding individual arbitration.
  • You waive jury trial and class actions.
  • Governing law: Delaware, USA.

13. Changes

We may modify these Terms at any time. Continued use constitutes acceptance.
